Sales Regulations of the "Szał dla Plastyków" Store
 
§ 1
 
General Provisions
 
These Regulations define the rules for the sale of Goods included in the offer of the Szał dla Plastyków Store in Krakow.
The names used in the Regulations mean:
Seller: Magdalena Serafin conducting business activity based on the entry in the Central Register and Information on Business Activity under the name of Sklep Szał dla Plastyków in Krakow with its registered office at ul. Pijarska 2 (31-015 Krakow), with the Tax Identification Number (NIP) 679-000-71-39;
Store, Online Store - a store run by the Seller;
Consumer - a natural person entering into a legal transaction with the entrepreneur that is not directly related to their business or professional activity;
Customer: a consumer, as well as another legal person, natural person or organizational unit without legal personality making purchases in the Store;
Goods: paints, cardboards, brushes, easels and other movable items offered in the Store,
Courier: carrier to whom the Seller orders the delivery of the purchased Goods.
The purchase of Goods takes place on the terms specified in these Regulations.
 
These Regulations may be copied in whole or in part to any digital medium or printed before placing an order.
The cost of telecommunications calls to the Seller is in accordance with the tariff applied by the telecommunications operator whose services the Customer uses.
 
§ 2
 
Information about the Goods
 
Information about the Store's offer and available Goods is placed on the website of the online Store www.szal-art.pl and is available in the Store at the telephone number +48 12 630 93 90. They constitute an invitation to conclude a contract within the meaning of art. 71 of the Civil Code.
 
All prices of Goods posted on the website of the online Store www.szal-art.pl include VAT and do not include delivery costs.
The Seller reserves the right to make changes to the prices of the Goods on an ongoing basis and to conduct and cancel all types of promotional campaigns and sales. The above authorization does not affect orders placed before the date of entry into force of the price change, terms of promotional campaigns or sales. If, due to a system error, the product appears on the website at a zero price, and the customer adds it to the order, it will be omitted from the order as an unpaid product.
 
The Seller informs that the colors of the samples posted on the website of the online store www.szal-art.pl may differ due to monitor parameters.
 
§ 3
 
Acceptance and execution of orders
 
Orders from Customers are accepted by the website www.szal-art.pl without interruption.
The basic condition for the execution of the order is the correct completion of the order form posted on the website of the online store www.szal-art.pl.
The order will be executed provided that the Product is available in the Seller's warehouse. Placing a zero price next to the Goods in the order offer means that they are not available at the Seller's warehouse at the given moment and will not be sent. We inform you that Goods found through internet search engines (not directly through the website www.szal-art.pl may not be in the Seller's offer.
In the event of unavailability of some of the Goods covered by the order, the Customer is informed about the status of the order and decides on the method of its execution (partial execution or cancellation of the entire order). This also applies to Goods currently unavailable on the Store's website.
A limited number of Goods are intended for promotional sales and clearance sales and orders are fulfilled in the order in which orders for these Goods are received until the stocks covered by this form of sale are exhausted, while orders paid on delivery are fulfilled immediately, orders paid in advance are fulfilled after the payment has been posted to the Seller's bank account.
The Customer may make changes to the order until the sales document (invoice) is issued. The Customer may withdraw the placed order in its entirety until it is sent. The above changes can be introduced by contacting the Store electronically at [email protected].
 
§ 4
 
Orders in the Online Store
 
Before starting to place orders via the website of the Online Store www.szal-art.pl, the Customer must register. As a result of registration, a password is assigned to the login provided by the Customer.
The Customer registers for the first time by:
filling in the registration form and accepting the terms and conditions contained therein,
confirming the registration by clicking on the link contained in the registration e-mail sent by the Online Store to the e-mail address provided by the Customer in the registration form (WARNING - the e-mail may end up in SPAM).
 
Each subsequent purchase in the online store requires logging in by providing the correct login and the corresponding password.
 
Purchasing Goods offered by the online store requires the Customer to place an order for the designated Goods and confirm it by clicking on the button: Order and pay.
 
After placing a correct order, the Customer receives a confirmation of acceptance of the order along with the Seller's bank account number.
 
§ 5
 
Payment for purchased Goods
 
Payment for purchased Goods and for the costs of sending the purchased Goods is made upon delivery by the Courier or in the form of prepayment - by bank transfer to the Seller's bank account provided in the order confirmation.
The order number should be provided in the transfer. The date of payment is the date on which the bank credits the Seller's bank account (posting the payment) with the amount due.
 
If the Customer is a VAT payer and wants to receive a VAT invoice, they should provide the Seller with all the data necessary to issue the invoice. By default, the invoice is issued to the Customer's data provided during registration, and not the shipping data provided in the order, unless the customer indicates otherwise.
 
§ 6
 
Discount program for regular customers
 
The Store offers an attractive discount system to customers who have expressed their willingness to receive the Szal-Art newsletter.
Discounts (reductions) in the amount specified below are granted to Customers who made purchases in the Store for an amount of at least:
PLN 1,000.00 - 3% discount
PLN 5,000.00 - 5% discount,
PLN 10,000.00 - 7% discount
The discount received by the Customer will be automatically calculated for each subsequent order. The granting of a discount or a higher discount in connection with the order placed and the completion of the execution of this order, i.e. after the payment for this order has been posted to the Seller's bank account.
Discounts are calculated for each account separately - orders from different accounts belonging to one person are not added up.
Discounts are calculated only for the price of the purchased goods - they do not apply to shipping costs.
 
§ 7
 
Delivery of the purchased Goods
 
The delivery of the purchased Goods will be made by a Courier, i.e. Polish Post or another postal operator. The Goods will be sent by priority mail within the time specified for the product. If the dimensions of the shipment exceed 0.9 meters - exclusively via a courier company. Delivery of courier shipments within Poland takes place within 2 business days, in the case of Polish Post, the delivery time varies from 2 to 14 business days. This period is counted from the date of shipment.
 
The fee for delivery of the purchased Goods is calculated according to the Courier's tariff (price list) including VAT. (Price List)
For a one-time purchase of Goods with prepayment of at least PLN 199, the Store covers the costs of delivery of the Goods, except for deliveries sent abroad and deliveries of Goods on pallets. In these cases, the costs of delivery are agreed individually with the Customer, taking into account the size of the shipment, weight or country of delivery.
After sending the parcel with the ordered Goods, the Courier sends the Customer an electronic or text message confirming the shipment of the ordered Goods along with the shipment number. The Seller sends the Customer an electronic message about the shipment of the ordered Goods along with the shipment number
When receiving the parcel from the Courier, the Customer is obliged to check whether the parcel is undamaged or whether the packaging is damaged. In case of doubt, the parcel should be opened and checked in the presence of the Courier. If after unpacking the parcel, the Customer finds that the delivered Goods are damaged, a damage report should be written, photos of the damaged Goods should be taken and the Seller should be contacted to replace the damaged Goods. § 8
 
Consumer Rights
 
In accordance with art. 27 et seq. of the Act of 30 May 2014 on consumer rights (Journal of Laws of 2014, item 827), the Customer - being a consumer within the meaning of art. 221 of the Civil Code - is entitled to withdraw from the contract without giving reasons and without incurring costs, by submitting an appropriate written declaration to the seller and returning the purchased Goods within 14 days of receiving the purchased Goods. The consumer may also withdraw from the contract using the model withdrawal form or by submitting a declaration on the website www.szal-art.pl. HERE LINK (WITHDRAWAL FORM)
The seller is obliged to immediately send the consumer, by electronic means, confirmation of receipt of the declaration of withdrawal from the contract submitted in this way.
The seller shall refund the payments received from the consumer, including the costs of delivering the Goods, within 14 days of receiving the consumer's declaration of withdrawal from the contract to the account indicated by the consumer or by postal order to the address indicated by him.
The Seller may withhold the refund of payments received from the Consumer until the Goods are received back or until the Consumer provides proof of their return, depending on which event occurs first.
 
If the Consumer has chosen a method of delivery of the Goods other than the cheapest standard method of delivery offered by the Seller, the Seller is not obliged to refund the Consumer the additional costs incurred by him.
 
The Consumer is obliged to return the Goods to the Seller immediately, but no later than 14 days from the day on which he withdrew from the contract. To meet the deadline, it is sufficient to return the Goods before it expires. The Consumer shall only bear the direct costs of returning the item (returning).
 
In the case of the return of large-sized Goods, i.e. the height of which exceeds 130 cm or the sum of the lengths of all sides exceeds 290 cm or the weight together with the packaging exceeds 30 kg, the method of return should be agreed with the Seller.
The Consumer is liable for the reduction in the value of the Goods resulting from their use in a manner that goes beyond what is necessary to determine the nature, characteristics and functioning of the Goods,
The right to withdraw from the contract does not apply to the Consumer if the subject of sale is Goods delivered in a sealed package, which cannot be returned after opening the package due to health protection or hygiene reasons, if the package was opened after delivery.
 
§ 9
 
Complaints
 
The Seller is obliged to deliver Goods free from defects to Customers. In the event of delivery of defective Goods, the Seller shall be liable for the identified defects of the purchased Goods pursuant to the provisions of the Civil Code.
The Customer shall notify the Seller of the identified non-conformity of the goods in writing by post or electronically and shall deliver the complained Goods to the Seller's registered office.
In connection with the complaint, the Customer may request: free repair or free replacement of the Goods with new ones free from defects or a reduction in the price paid or may withdraw from the contract and request a refund of the price paid.
The Seller is obliged to confirm receipt of the complaint electronically by sending the Customer a confirmation and to respond to the complaint within 14 days of its delivery and inform the Customer within this period about the method of its resolution. The notification will be sent to the Customer electronically.
In the event of a price reduction or withdrawal from the agreement, the Seller shall transfer the amount due within 14 days from the date of acceptance of the complaint by bank transfer to the account indicated by the Customer or by postal order to the address indicated by him.
 
§ 10
 
Protection of personal data and privacy policy
 
The Seller, i.e. Magdalena Serafin, conducting business activity based on an entry in the Central Register and Information on Business Activity under the name of Sklep Szał dla Plastyków, in Krakow with its registered office at ul. Pijarska 2 (31-015 Krakow), with the Tax Identification Number (NIP) 679-000-71-39,
and the related entity, i.e. Zofia Serafin-Domagała, conducting business activity based on an entry in the Central Register and Information on Business Activity under the name of Sklep Szał dla Plastyków, in Krakow with its registered office at ul. Warszawska 1 (31-155 Krakow), with the Tax Identification Number (NIP) 677-237-69-49, is the administrator of the personal data of the Customers.
By registering or logging in to the Online Store, the Customer consents to the processing of their personal data provided in the registration form by the Seller. Providing personal data by the Customer is voluntary, however, failure to consent to the processing of personal data by the Seller may prevent the Seller from providing services electronically and the Customer from making purchases in the Online Store www.szal-art.pl.
 
Detailed information on the protection of personal data provided by the Seller is included in the Privacy Policy of Szal dla Plastyków.
 
Customers have the right to request that the Seller, as the administrator of their data, supplement, update, correct personal data, temporarily or permanently suspend their processing or delete them, if they are incomplete, outdated, untrue or have been collected in violation of the Personal Data Protection Act or are no longer necessary for the purpose for which they were collected.
The Seller is entitled to disclose personal data administered by it only to bodies authorized under applicable law.
The Seller uses cookies, which contain information necessary for the proper functioning of the Store, in particular the process of authorization and remembering personal settings. Cookies are not used to process or store personal data. (PRIVACY POLICY)
 
§ 11
 
Newsletter
 
The Customer may consent to receiving commercial information, including commercial information electronically, by selecting the appropriate option in the registration form or later in the tab: Your account (link: Newsletter). In the event of such consent, the Customer will receive the information bulletin (Newsletter) of the Online Store www.szal-art.pl to the e-mail address provided by him/her, as well as other commercial information sent by the Seller on his/her own behalf or on behalf of third parties.
The Customer may at any time cancel the Newsletter subscription independently by unticking the appropriate box in the tab: Your account (link: Newsletter).
ing illegal activities or which could prevent or hinder other Customers from properly using the Online Store. In particular, the Customer is obliged to:
not use the Store to conduct activities that are against the law or in a way that may constitute a violation of the law and hinder other Customers from using it,
securing and protecting confidential data such as access passwords,
not attempting to violate the Seller's system resources to which the Customer is not authorized,
complying with the statutory prohibition on the Customer providing content of an illegal nature.
§ 13
Final provisions
The Seller is entitled to change the provisions of these Regulations. The amended Regulations shall apply from the time of their publication on the Online Store website.
These regulations are available in electronic form on the website www.szal-art.pl
Information about the Seller shall be confirmed by the Seller in writing each time at the latest at the time of delivery of the Goods to the Customer.
In matters not regulated in the regulations, the provisions of Polish law shall apply, including the Civil Code.
Any disputes between the Operator and the Portal Partners will be resolved by a competent common court
Only for consumers
